I think a lot of people overuse HDR. A lot of images look worser with HDR, when without. I prefer HDR used with landscape and architecture, just to balance dark and light parts of the image and bring out more details. But if used correctly, HDR can look very cool on the images with people as well. Just look at Dave Hill work http://www.davehillphoto.com. But I believe there is much more to it then just a use of HDR software.

It is certainly not the happy or colorful image typically posted to photography forums.

Why is the subject in the position that he has taken? Is the photo from the point of view of a police officer who has just made an arrest and is about to perform the obligatory search of his suspect?

At first I thought the wall on which the man is leaning should be straightened. I actually tried this with photoshop to see the result. No, it is better this way. Even the wall conspires against this helpless escaped convict, which I have just decided he is. If so.... his shirt is the correct color and it's emphasis a hint to the mystery.

I also like the texture of a brick wall. I just feel that HDR is a bit to harsh in this image.I am not sure about the shirt being stong blue color and everything else is desaturated. Maybe try to go either all image black and white or the whole image in color. Just a suggestion.
